Fourth degree murder is when there is an accomplice who did not commit the murder themselves or when a person influences another to kill the victim.

Although it varies by jurisdiction. In Texas an accomplice to felony murder is as guilty as the murderer, according to the law of parties. So if the trigger man is sentenced to death, his or her accomplices (even though they took no part in the murder) will get the same death sentence.
